With the transition into 2022, new laws are going into effect on the state level across the country. Included in these new laws are changes that directly affect employers’ paid leave policies, harassment and discrimination rights, and vacation days.

 

2022

  • California expands limitations on non-disclosure provisions in agreements resolving harassment and discrimination claims effective January 1. California also expands CFRA effective January 1.
    • Senate Bill 331 expands this prohibition on settlement confidentiality to include all types of workplace harassment or discrimination (not just sex-based).
    • Under the California Family Rights Act (CFRA), eligible employees may take 12 weeks of leave per year to provide care to family members, including parents, with serious medical conditions. Effective January 1, 2022, AB 1033 expands the definition of “parent” under the CFRA to include parents-in-law.
